NHLPA files grievance over Nashville Predators' qualifying offers
The proverbial stuff is hitting the fan, Predators fans. An NHLPA spokesman has confirmed to me that the players association has, this evening, initiated a grievance over the Qualifying Offers given to 7 Nashville Predators earlier this week.
So where could this whole episode go from here?
- This issue could go before an independent arbitrator (George Nicolau, according to TSN's Bob McKenzie), and if the Preds are found not to have delivered their Qualifying Offers in the proper manner by Monday's 5:00 p.m. Eastern deadline, the 7 players would become unrestricted free agents.
- The Preds could come out victorious in the hearing, and the players remain as Restricted Free Agents.
- The Preds and the players start agreeing to some contracts before the hearing takes place (although the players will certainly enjoy a stronger negotiating position right now).

What would you say in the case that an arbitrator sides with the Preds? Just because the PA has filed a grievance doesn’t mean the Preds have actually messed up.

This shouldn’t even be happening! He has one job to do this time of year! We shouldn’t be put this or have to worry about this at all! That’s the point.

He has a lot of things to do, just calm down. People are losing their minds over something, something of which we have too littler information. The league and the team both state that there were no issues with the filing. That is a bold statement in the face of the grievance. We shouldn’t be sharpening the axe before we have all the information and before the arbitration is complete.

A chimp can use a fax machine. The league has no say, a third party will per CBA, why would we leave this in someone else’s hands. This is dumb on so many levels.
…what? The league reported that they received the paperwork on time and they were not aware of the problem. Poile filed the QOs with the league. So the league has a say insofar as providing information as to when the QOs arrived and if they were properly fired.

The trick here is that the deadline is met for the players to receive the QO’s, not the NHL.

The deadline in question here is for the team to tender the offer to the player by 5:00 p.m. Eastern on Monday. Their acceptance of the offer doesn’t matter, as many of these negotiations drag out into August.

Everyone should calm down and quit filling diapers over this. More than likely, 6 of 7 of the players listed are still hear without much of a fuss.
Kostitsyn is probably the only one who will garner serious interest and with how he was perceived prior to playing last year, one would think he’s the second coming with the turn around the fans have had with him.

But Poile did not “blow him off”
It says that Rads told the team about the offer from Russia. He says he wanted certainty and then talks about how he’d been heavily considering a return to Russia. You make an assumption of a particular response with no verification. It would be far more likely that Poile would’ve told Rads that contract negotiations would occur later, not anticipating that the player would leave for his home country. I am make a lot of assumptions in that final statement.

Were you even around then? You would know that Poile himself said he didn’t take Radulov seriously. He told him that he would have his time to negotiate a contract the following season.
Poile couldn’t negotiate a new contract then, Radulov wasn’t yet in the final year of his deal.

Answered my own question with google, it was July 11th, so during free agency. To be honest, Poile probably called his bluff, and didn’t call because he didn’t think it was possible with insider information that a deal was coming to prevent that situation. Radulov speculated that himself;
“They said they would call me back but never phoned. It seems that they were either not really interested in me or just did not believe I could return home. One way or another, I’m happy to come home.”
No way Poile wasn’t interested in Radulov.

It was actually July 5th. If it had been the the 11th, he would of had to stay here. They reached the agreement with the KHL on July 10th that kept players from swapping leagues if already in an existing contract. Terrible luck.
My fault, I read the article reported on the 11th, and of course he signed it beforehand, that was the loophole.
It’s outrageously terrible luck. Overall, I’m a fan of Poile’s, mainly because I’ve had the impression that with the Caps, he put a team together that kept the team in town on a minimal budget, and I’d observed a similar situation in Nashville (again, from outside looking in). It seems he makes forced hand decisions and really stuck by his gut on that one, and this could honestly be a clerical error. I doubt Poile faxes his own paperwork in (if he doesn’t, he should), but this could be someone else’s fault. Then again, if he files at 2, there’s no issue. You’d think teams would want to Qualify them as early as possible, so they start getting leverage sooner.

I’m just worried Weber will become our Scott Stevens. It looks like Poile has avoided that mistake so far. Poor caps fans.
In a way, what Poile lucked into from Stevens leaving helped the team be competitive until it’s finals run, and we’re still seeing the effects of players who the team’s acquired being traded/and so on/and so on. But, Weber is so good. I’d do bad things to force Poile into a Green-and-Semin-for-Weber-and-Suter-and-Hornqvist trade, which will never happen.

Radulov bolted on July 11, so he was in the final year of his deal.
Malking signed his latest contract on July 2nd, so he was in the final year, too.

Yeah, I was, but as stated, I’m a Caps fan. Trust me, we’re dealing with nearly the same situation with Varly right now. You can hate Poile all you want, but Poile probably knew a deal with the KHL was coming, and he probably banked on that. I probably would have too. Also, as Dirk has mentioned, it would have been illegal to talk to him at the time.

the “never called” part is not addressed in the translated interview. It may just be Wyshynski being Wyshynski. A player says he told the team he had offers and wanted a commitment a year early. You can’t assume that there was no further discussion and that “Poile blew him off.” It’s in Rads best interest to make himself out the victim there and that may have colored how much he told this reporter.

none of these players are irreplaceable. I think a lot of people are overrating Koistytsn’s talent. Is anyone remembering the complete failure of him in the playoffs?
O’Reilly and Spaling would be the biggest two losses. This may make a case for Poile to go ahead and resign Goc as well.
Obviously I’m watching from afar in Caps land, but I consider the Preds my western conference team, and a lot of that has to do with David Poile (also with where my family is from and the family reunion is, but that’s a digression). This is infuriating. I want to support Poile, but this is stupid. Why do you put it off to the last minute? I got a written warning at work for filing a paper 5 minutes late.
I agree that O’Reilly and Spaling would be the biggest losses, and I’d almost feel bad as a Caps fan trying to sign one, but I’d want them.
Regardless, joke of a situation, and I’m hoping hard that the arbitrator rules for you guys.

I would rate losing O’Reilly as suck regardless. There are no centers outside of Richards worth him on the market. I’m not even sure if long term he’s a worse option than Richards. I may be overvaluing a player like COR but in this weak free agent class, you do not want guys like him and Spaling as UFAs.

This league tends to over-value potential. Basically, with Spaling and O’Reilly, consecutively, a team could look at it as signing a 2nd or 5th round draft pick, respectively, without ever having to draft them, especially since both are good young prospects. Between them and AK74 it’s not a fun situation to be in.

Yep. He is overrated. I’m glad you’re drinking the kool-aid though. my point was that none of these guys are irreplaceable. Our team isn’t going to fall to pieces if Kostitsyn doesn’t return. I’m sure most of these players will be back into the fold, but even if everyone leaves we’re still not going to be 15th in the West. Now take a Xanax and watch some TV.

What I meant to say was it would be a huge loss if SK74 was gone simply because we would get nothing for him, and we could have signed him for one more year at $660,000. Not a bad price and leaves us with money to possibly sign a scoring FA.

Just to be clear, if the Preds make a $660,000 Qualifying Offer to SK74, there’s no requirement on his part to accept it. He’s going to get a major raise this season, but obviously it’ll be much larger if he can become a UFA.

Maybe this will all go well for us in the end, we don’t know either way right now, but the fact that we got ourselves into this situation in the first place is embarrassing. 29 other teams can qualify their RFA’s without a hitch but we can’t? C’mon folks, we screwed up here and either Poile or Fenton or whoever waited til the last minute to get these qualifying offers out to these 7 players needs to be held to account here.
As far as who would it hurt the most to lose, of course it would be SK74. He’s the only legit top 6 forward out of the bunch and we’re already short one of them on our team. How on earth someone can say losing Cal or Spals would hurt more is as bewildering as our drafts.
The big question is: when would this hearing take place to determine the status of these players? If it drags on thru the summer, then that alone will set us back even if the hearing goes our way. Good grief, Charlie Brown!!!

It’s an embarrassment. This franchise can not afford self inflicted wounds, we don’t have the margin for error. Can’t wait to read about this in the main stream hockey media.
I am soooo not concerned about being embarrassed in the mainstream media. That’s not at all what worries me. While it is nice when they say nice things about the city and the franchise, it doesn’t make this a worse team when they don’t. I am concerned about the long-term ramifications of having to pay more on contracts.

Hornqvist was our Kostitsyn prior to last year… lets see some consistency out of SK before we go anointing any of our forwards the next Kariya. my point is we get a cast off from Montreal for next to nothing, he has 1 good season and everyone is up in arms about the “possibility” of losing him. I hope you’re right about him and his ability to replicate last season, but I’m not going to break down the doors to Bridgestone Arena so I can lynch David Poile about one of his staffers screwing up a fax. We are by far the best expansion team to come out of the last crop and I will go so-far as to say we have one of the top 5 organizations in the NHL. I’m not running Poile out-of-town after this clerical error.
Not getting anything in return is the problem. It is one thing if you don’t match an offer given to an RFA, cause you get something in return. There will be zero recourse if this goes against us. There’s no excuse. We are throwing away top prospects in our organization for nothing, if this happens.
If we are in error (which still is to be determined), I’m still not willing to fire our GM if we get 0 compensation from this.
There is no way you can convince me getting rid of Poile is the solution. Have you seen how many other teams are screwed up b/c their GM signs boneheaded contracts? Lets not throw the baby out with the bathwater.
You know, this might be more interesting if we were to poile David Lynch…

I Figured it out!!!
Poile and the rest of the front office were so busy trying to sign Jagr AND bring Radulov back that they forgot to make their qualifying offers.
Hmmm....
Look at all these people spouting off at the mouth with no facts whatsoever, other than Dirk posting that a grievance was filed. I guess you can tell alot of people are frustrated the Preds didn’t make any moves around the draft as well. The guy was a finalist for GM of the year last year, and the year before and …… Oh yeah, but alot of you guys could do alot better from the recliner. Geez. I have no problem with people being annoyed, but some of you are acting like Poile just kicked your dog and called your mother fat….
I think the vitriol has to do with the fact, true or not, this was totally avoidable. This isn’t a judgement on a pick or a trade or a personel decision. We shouldn’t be here now. It doesn’t take one to be a GM to know that.
So… you, along with everyone else, has seen the PA grievance outlining exactly what happened? I will be the first one to say Poile screwed the pooch if it comes out that he or his staff made aggregious errors, but right now I don’t have any info. Unlike alot of the people on here that are having labor pains over this, I choose to sit back and see what happens. Too many cold beverages out there to get bent out of shape about what may or may not have happened.

He’s going to have to sign a lot of FA’s to make up for this. Milwaukee has to be able to field a team and I know we wanted to go with some more youth, but these guys are our youth, and such a simple matter of sending QO’s in a reasonable amount of time seems like such a asinine way of running a professional franchise.

Even if the NHLPA rules against the Preds, they still can sign these players – unfortunately at a higher cost. But, they are not lost immediately. Being the budget-minded team we are, some we may let hit the free market. Some we sign even with some overpayment.

ok so from what i understand
It sounds like the NHLPA and the Preds have a disagreement as to how to interpret the NHL CBA. Now is this in regards to what time the team filed the QO or what time the agent received the QO.
If this is the case then it will get straightened out and the rule will be clarified and will (should) not be applied to this case. Then we can all move on and try to forget how everyone over reacted to it.
To support that idea both the team and the NHL office stated today that they saw nothing wrong with the filing of the QO’s. If this is not what the squabble is about then i have no idea what the problem is with them
I agree with the idea that there’s more to be determined on this. The real problem is not that the language is vague. though. It’s that IF the arbitrator determines that the offers were not tendered in the proper way then these guys become UFAs rather than RFAs. That means they hit the open market and can take any offer and if they sign with another team we get no draft pick compensation for losing them. It’s much more than a matter of clarifying the language. It’s a matter of deciding which side of it the team comes down on.

From the day after the conclusion of a Player’s Playing Season until the commencement of the Player’s subsequent Playing Season, notice(s) shall be sent via overnight delivery to the Player’s off-season address which the Player provides to the Club, and if no such address is provided by the Player, the notice(s) shall be sent via overnight delivery to the Player’s last known address.
Then, further down:
If no method of service is specified in this Agreement, service of the required notice shall be effectuated by either facsimile transmission or overnight mail delivery by an established nation-wide delivery service (e.g., FedEx, Overnite, Airborne, etc.)…
To me, imho, this clearly states that all we needed to do is send them the offer prior to the 5pm deadline to their last known address. This has absolutely no bearing on whether they get the fax at 4:59, 5:01, or the next day for that matter. If the organization has a fax confirmation page showing it was “received” we should be good.
Yes, I’m pretty sure it would have to be read as just sent by the appropriate time. Otherwise, this would happen all the time with players in some remote town overseas – you’d have to send it a week or two ahead of time just to be sure.

My understanding was that when the Chicago thing happened a few years ago, the language was just as vague and it hasn’t been cleared up yet. It still isn’t as simple as “what do you mean by tendered? Here's another nitpick I have with this whole scenario.
Why do we not lock up players for longer? I’m not talking Kovalchuk-length contracts here. But like with these guys (SK excepted) why not lock them up for 3 or 4 years? Unless the players/agents really don’t like that? But, I think it would be worth it to prevent yearly scrambles like this.
Regarding going 0-4 in the NHL Awards, I quote the great Hornqvist: "S**t's gonna happen."
Well, I’m thinking with SK&$ at least that it was a bit of a gamble on the team’s part to take in on at all. So a short-term deal gives the team an out if it goes bad and doesn’t perform. Maybe true to a lesser extent for the other young guys. Not sure what restrictions there are on ELCs. Again, I’m just speculating here. There’s a reason I don’t negotiate contracts for a living.

Yeah, I don’t have enough info on it, but this is a mess. I am amused by the thought that Trotz might have to use Dumont in a key role now. I still think Dumont can contribute, but Trotz keeps him in garbage roles.

the rationale behind waiting until the last minute to send these offers? There must be some reason. One of you super-bloggers with access to DP should ask him this question!

I think that is a solid question for maybe a different reason than you intended.
What is common practice among GMs and sending out Qualifying Offers? We only ever hear any details when something goes wrong, but it could potentially be standard operating practice to send out offers just before the deadline. Likewise, if we charted mailing times it could be some hideous scatterplot. Personally I’m curious.

Owners could send out the offers at the last minute to cover themselves against something happening to the player after the contract is extended. A bit of a stretch, but I’m sure it’s in the back of some of the GM’s minds. Imagine the scenario where we send out a contract a day early and that night the player fractures his femur and his playing career is over. There is no way for us to get out of the contract because all contracts in the NHL are guaranteed.
That is the only scenario I can think of where we would be kicking ourselves for not waiting until the last minute.
And also, if you are going to attempt to trade a player to another team, it’s probably easier to do it at their current salary then at the raised salary you will have to give them after the deadline. So the GM attempts to wheel and deal some players right up to the last minute, and then if no deals go through, extend the contracts to keep the players.

The rule seems clear to me. Either overnite delivery or fax…..There is nothing in the rule, as written, indicating the offer must be received before the deadline, only sent. If the Preds have fax receipts and/or dated overnite material showing a date and time before the deadline, I don’t see the issue.
So……Who complained to get the whole grievence thing going? A player?

agreed. I wonder too if a disgruntled player complained when his correspondence didn’t arrive when he thought it should have. Egos, egos, egos. I’m not worrying about this until I have to, and when I have to, then it’s too late to worry anyway! lol works for me!

Just a thought here, but........
Could this be as simple an error of not getting time zones correct, as in sending out the QO’s on CST instead of EST? Don’t know at this point, but that would be embarrassing if it turns out to be the case.
